Land Clearing Permits in Birmingham & Jefferson County

Most people start a permit question with “how many acres.” Around Birmingham that is the wrong opening, because neither the city nor the unincorporated county writes an acreage figure into its land disturbance trigger. The acre matters at the state layer. Locally, what decides it is whether your work falls inside a short list of exemptions.

Inside the City: a Permit Before Anything Starts

Birmingham’s General City Code, section 4-7-11, makes it unlawful to commence or continue any land-disturbing activity that is not exempt without first obtaining a soil erosion and sediment control permit from the city engineer. A separate permit is required for each site, and holding one does not excuse you from any other state or local permit (City of Birmingham, General City Code ch. 4-7).

Read the definition rather than the headline. Section 4-7-12 defines land-disturbing activity as any land change that may cause soil erosion and movement of sediment, including clearing, dredging, grading, excavating, transporting and filling. Clearing is named. There is no acreage qualifier anywhere in it.

What Section 4-7-12 Exempts, and What the Permit Costs

The exemption list is where most residential jobs land, and it is narrower than it first reads. The code exempts agriculture and silviculture; minor activity such as home gardens, landscaping on individual residential lots, home repairs and maintenance and accessory structures causing minor soil erosion; minor grading for driveways, yard areas and sidewalks; minor work on existing underground utility lines other than sewer; railroad track work; minor exploratory excavation under a soils engineer; individual burial sites; and digging water or monitoring wells.

Two carve-outs inside the carve-out matter. Landscaping on a residential lot is exempt except when it is performed by or for a developer or builder putting a house on that lot, and the same exclusion applies to minor grading connected with building a house. If a builder is involved, the residential exemption stops applying.

Once a complete application is filed with the owner’s best management practices plan, the city engineer has 14 days to accept or reject it, in writing with reasons. Structural practices have to be certified by a professional engineer registered in Alabama.

The fee schedule in section 4-7-14 is short:

Those figures are current as of September 2026. Applications go to the city’s Department of Planning, Engineering and Permits.

Unincorporated Jefferson County: Register the Plan First

Outside the municipalities, Article 13 of the Jefferson County Subdivision and Construction Regulations runs the same way. Section 13.21 requires that, before the commencement of any land-disturbing activity that is not exempt, the owner or a duly authorised agent register an erosion and sedimentation control plan with the county. Section 13.22 exempts agriculture, silviculture and the same family of minor residential activities the city exempts (Jefferson County, Article 13).

The county attaches a surety to the jobs it permits. Section 13.50 sets it at $3,000 per acre or portion of an acre, and doubles it where the clearing or earthwork is in floodways, floodplains or areas susceptible to landslides. It has to be issued by a bank with a branch in Jefferson County. In county paperwork the instrument is called a Land Disturbing Permit for Erosion and Sedimentation Control (Jefferson County regulations and permitting).

Where the One-Acre Rule Actually Lives

The acre most people have read about is the state and federal stormwater layer, not the local one. ADEM’s NPDES construction general permit applies to land disturbance equal to or greater than one acre, and also to work under an acre when it is part of a common plan of development or sale that reaches one acre (ADEM).

Put plainly: a half-acre back lot inside Birmingham can need a city permit while needing no ADEM registration, and a two-acre site can need both. Establish which layers hold your parcel before anyone prices equipment. Requirements vary by parcel, scope and jurisdiction, and the governing authority makes the determination.

Burning the Debris: a Seven-Month Closure

Jefferson County is stricter than most of Alabama here, and this catches people out. Under the Jefferson County Board of Health Air Pollution Control Rules, chapter 5, outdoor burning is prohibited from April through October, food preparation aside. Authorizations to burn from November through March carry strict conditions on location and the equipment standing by, and burning non-vegetative material is prohibited outright. The health department evaluates proposed sites and takes smoke nuisance reports on (205) 930-1276 (Jefferson County Department of Health).

That sits on top of, not instead of, the statewide rule. The Alabama Forestry Commission requires a permit before burning any woodland, grassland, field or new ground over a quarter acre or within 25 feet of natural fuels such as woods or grass; permits are free by phone from the AFC dispatch centre (Alabama Forestry Commission). Both requirements are current as of September 2026.

The $100,000 Line on Licensing

Alabama licenses a general contractor as one who, for a fixed price, fee or wage, undertakes construction work including site work, grading and paving where the cost of the undertaking is one hundred thousand dollars ($100,000) or more. Act 2024-277 raised that figure from $50,000 effective 1 October 2024 (Alabama Licensing Board for General Contractors).

Most residential clearing sits well below that line. If your project is large enough to approach it, licensing belongs in the conversation before the contract rather than after.

Frequently Asked Questions

Do I need a permit to clear half an acre in Birmingham?

Quite possibly. The city’s trigger is the activity, not the acreage, so half an acre of non-exempt clearing needs the same city engineer’s permit that two acres would. Whether your work is exempt depends on the section 4-7-12 list and on whether a builder or developer is involved. The reviewing authority makes the final call.

Does forestry mulching need a permit?

That depends on how the office holding your address classifies the work, not on the name of the method. Grinding material in place leaves the root mat intact and disturbs less soil than grubbing the same parcel, which can matter to the classification. Ask before you book.

Who pulls the permit, me or the contractor?
