Land Clearing Permits in Starkville & Oktibbeha County, MS
Cut Brush Team · October 6, 2026 · 6 min read
Inside the City of Starkville, clearing done as a step toward construction needs a land disturbance permit from the city Building Department, and logging, timber harvesting and agricultural activity are exempt. The residential fee is $50 plus a $1 archives fee. Outside the city, Oktibbeha County publishes a site development permit application, but the page that hosts it does not say when it applies, so the courthouse is the place to ask. From one acre up, state construction stormwater rules also come into play.
This guide sets out who issues what, with each rule linked to its source. Requirements vary by parcel, scope and jurisdiction, and the governing authority makes the determination. Cut Brush can point out what commonly applies and which office to call, but the decision belongs to that office. Figures below come from the published documents as read on 6 October 2026; confirm them before applying.
Which Office Is Yours?
Start with one question: is the land inside the Starkville city limits or in unincorporated Oktibbeha County? Starkville is the only city this guide covers. Sturgis and Maben are in Oktibbeha County too, but we did not research their town rules. West Point, Columbus, Macon and Louisville are in other counties. If your land is in any of those, call that town or county before work starts.
Inside Starkville: the Land Disturbance Permit
The City of Starkville’s land disturbance application reproduces Section 16.8, “Erosion Control,” of the city’s Unified Development Code. It makes it unlawful to clear, clear cut, grade, level, excavate or fill, in the process of construction or as a preliminary to construction, without a Land Disturbance Permit from the Building Department. The trigger it states is disturbance greater than 1,000 square feet, or work that requires a building permit, whichever is smaller. That is a very low threshold, so a clearing job tied to a build will usually count.
Exemptions listed in the code include any logging, timber harvesting or agricultural activity, ditch or channel cleaning and drainage maintenance. Whether a mulching pass on your parcel is exempt or counts as land disturbance is the city’s call, so ask before the job is booked.
The process has an order to it:
- A control measures permit first. After a full application, the Building Department issues a control measures permit that specifies the initial erosion controls. No clearing, grading or grubbing may begin until city staff have inspected them.
- A written stormwater plan from one acre. The code requires a stormwater pollution prevention plan for any project whose property boundary is one acre or greater, and the application asks whether the disturbed area is over an acre.
- A buffer by streams. For natural or manmade streams and watercourses, the code calls for a 15 foot buffer measured from the top of bank, either left undisturbed or replanted.
- Wetlands and waterways. Clearing and grading of wetlands, waterways and watercourses is not permitted except in compliance with all other local, state and federal rules.
The application lists a fee of $50 for land disturbance for residential development, $50 per acre of disturbed area for commercial development, and a $1 Mississippi Department of Archives and History fee. The Building Department is at 110 West Main Street, and the application lists 662-323-2525 and permits@cityofstarkville.org.
Unincorporated Oktibbeha County
Outside the city, start at the county. Oktibbeha County’s documents and forms page lists a Site Development Application, a Floodplain Development Application and a Flood Damage Prevention Ordinance. The page does not say what activity triggers the site development application, and the form file itself did not yield readable text for us, so we do not state a threshold or a fee.
What we can say is where to ask: the Oktibbeha County Courthouse, 108 West Main Street, Starkville, at 662-323-1520. Tell the staff how many acres you plan to clear, whether any of it is near a creek or in a floodplain, and what the ground will be used for. If part of your parcel is in a floodplain, the county’s floodplain application is a separate form to ask about.
| Where the land is | Permit | Fee we could confirm |

| City of Starkville | Land disturbance, commercial development | $50 per acre plus $1 archives fee |
| Unincorporated Oktibbeha County | Site development | Not confirmed; call the courthouse |
State Stormwater from One Acre
Above the local permits sits the Mississippi Department of Environmental Quality. Its construction stormwater page lists the Small Construction General Permit for 1 to less than 5 acres and the Large Construction General Permit for 5 acres and greater. Both involve a stormwater plan prepared before work starts.
Mulching leaves roots in the soil and a chip layer on top, which is the kind of cover stormwater plans are written to achieve. Stripping the same acre to bare dirt is the kind of disturbance they are written to control. Tell any contractor how many acres will be disturbed and what the finish will be, so the paperwork matches the work. The city’s own code adds that for sites needing an MDEQ stormwater permit, a copy of the approved permit goes with the city application.
Burning
One more state rule rounds this out. The MDEQ open burning fact sheet says land clearing debris may not be burned where a local ordinance prohibits it, during a High Fire Danger Alert, or within 500 yards of an occupied dwelling without a forced-draft system (50 yards with one). That is why mulching, with no pile at all, suits most lots.
