Land Clearing in Granville County, NC: Permits and Cost

Granville County has no erosion control program of its own, so the rule for clearing land here is the state’s: disturbing more than one acre needs an erosion and sedimentation control plan filed and approved 30 or more days before work starts. NC DEQ reviews it for a fee of $119 per acre of disturbance. Under that, the questions that matter are which watershed your parcel drains to and how close you are to a creek.

Do I need a permit to clear land in Granville County?

Not a county permit. What you may need is the state plan above, and it applies across the county: unincorporated land, Oxford, Butner, Creedmoor and Stem alike. None of them appears on DEQ’s list of delegated local erosion programs, so plans go to the state, and Granville falls in the territory of DEQ’s Raleigh Regional Office.

Three points worth knowing:

• The trigger is acreage disturbed, not lot size. Clearing half of a three-acre tract is a 1.5-acre disturbance and needs a plan. Clearing an acre or less does not.
• The method does not change the answer. State law defines land-disturbing activity as a use of the land that changes its natural cover or topography and may cause sedimentation. A plan is needed above one acre whether the site is mulched or cleared to soil. The exemptions are for farming and for timber harvests run under the state’s forest practice guidelines, not for clearing a homesite.
• The penalty is real. DEQ can fine up to $5,000 a day per violation.

Separately, the county asks owners to contact its Planning Division before disturbing any land in the Falls Watershed Stormwater Zoning District. That call costs nothing and is worth making before a machine arrives in the south of the county.

Which watershed is my Granville parcel in?

Granville drains three ways, and the basin your land drains to decides which buffer and stormwater rules apply.

Butner and southern Granville drain to Falls Lake, and the county shares a Falls stormwater program with Person County, Creedmoor, Stem and Butner. Oxford sits in the upper Tar-Pamlico basin, a separate rule set. If you are unsure which side of the line a parcel is on, the county’s Planning Division can tell you whether it is in the Falls district.

Did the Falls Lake half-acre rule change?

Yes. The Falls Lake new development rule used to require a stormwater plan when a single-family or duplex project disturbed half an acre. Since 6 October 2025, no stormwater permit, plan or post-construction controls are required, under the Falls rule or a local ordinance adopted under it, for single-family and duplex homes that cumulatively disturb less than one acre and are not part of a larger common plan of development.

What that means on a Butner, Creedmoor or Stem lot:

• A single home or duplex site under one acre no longer carries a Falls stormwater plan.
• The change names only single-family and duplex homes. Commercial and multifamily projects should check their thresholds with the county.
• It does not touch the state erosion plan, which still starts above one acre, or the stream buffer.

Can I clear brush along a creek in Granville?

Partly, and it depends on what you are cutting. In both the Falls Lake and Tar-Pamlico basins the buffer is 50 feet on each side of the water: the first 30 feet (Zone 1) stays undisturbed and the outer 20 feet (Zone 2) stays vegetated.

The Neuse buffer rule lists removing understory nuisance vegetation as a deemed allowable use. Removing woody vegetation in Zone 1 falls in a different category that needs authorization before work starts. So thinning privet and vines along a creek edge is one question, and taking trees out of the first 30 feet is another that waits on the state. Before we quote a creek lot, we walk the stream and mark where 30 and 50 feet fall, because that line sets how much of the property a machine can work.

Mulching services in Granville County

Most Granville jobs we are asked about are forestry mulching: a tracked machine grinds brush and small trees where they stand and leaves the chips on the ground, so nothing is burned or hauled. It suits overgrown pasture, fence rows and wooded homesites where the owner wants the understory gone and the good trees kept.
